This website is operated by Yoga My Life. Throughout the site, the terms “we”, “us” and “our” refer to Yoga My Life. Yoga My Life offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Please read the following Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the Terms & Conditions that apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants and/ or contributors of content.

We reserve the right to update and amend these Terms & Conditions at any time. Any new features or tools which are added to the current site shall also be subject to the Terms & Conditions. You can review the most current version of the Terms & Conditions at any time on this page. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms & Conditions. Your continued use of or access to our website or the Service following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms & Conditions.

Our Site is hosted on Cloudways. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

GENERAL TERMS OF SALE

By placing an order you are offering to purchase a product or service subject to the following Terms & Conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays, issues or force majeure for which we will not be held responsible.

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

PRICING & INFORMATION

Although we strive to maintain the lowest possible prices at all times our products and services will on occasion be subject to change. We reserve the right to do this without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. The prices payable for goods and services that you order are as set out on our website. 

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns Policy. We reserve the right to limit the quantities of any products or services that we offer.

Where it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, and offer to sell you the goods of the specification and description at the price stated in the email and will state in the email the period for which the offer or the price remains valid.

Voucher codes are valid on full priced items and some discounted items too. They cannot be combined with another offer. For example, 3 for 2, Buy 1 Get 1 Free or % Off Deals.

Instagram Competitions 

1. Entry implies acceptance of these terms and conditions.

2. Entry to prize draws is open to all UK residents aged 18 and over, except employees and their immediate family of Yoga My Life Ltd.

3. No purchase necessary to enter the Promoter’s competition on Instagram. Please note, this competition is in no way affiliated, sponsored or administered by Instagram.

4. To enter one of the Promoter’s promotions, you must follow Yoga My Life’s Instagram handle: @yogamylife.now and like the competition post from the @yogamylife.now Instagram account and tag two friends by the relevant closing date and time; such method to be specified in the relevant promotional post on Instagram

5. Only one entry per person. No third party or bulk entries. Proof of entering is not proof of receipt.

6. The Promoter does not accept responsibility for entries incomplete, delayed, damaged, wrongly delivered or not received for whatever reason.

7. There is no cash or alternative to the prizes stated, and the prizes are not transferable. No part or parts of the prizes may be substituted for other benefits, items or additions. If winners are unable to take the prize for whatever reason, a redraw will take place.

8. The winner will be selected at random, the draws will be held within seven days of the closing of the relevant promotion. The Promoter’s decision is final and binding. No correspondence will be entered into.

9. The prizes in respect of a particular promotion will be set out in the Instagram post relevant to that promotion. Please note, the images used are for promotional purposes only and the contents of the prize may differ from that shown.

10. Winners names will be announced on @yogamylife.now and instructions will be included on how to claim the prize. The winner may be contacted by an Instagram post or Direct Message.

11. Unless otherwise stated, winners must accept prizes within 28 days of notification or a redraw will take place.

12. The Promoter reserves the right to substitute a prize of equal or greater value if necessary.

13. Any personal information you give us will be used solely for this competition and will not be passed on to any other parties without your agreement.

14. Unless otherwise stated, the Promoter is Yoga My Life Ltd.

15. Under no circumstances will Yoga My Life Ltd be responsible for any loss, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in the promotion of the competition or prize.

16. Yoga My Life Ltd will not be responsible unless required by law, for any loss, changes, costs or expenses, which may arise in connection with this competition and Yoga My Life Ltd can cancel or alter the competition at any stage.

17. Any dispute relating to the competition shall be governed by the laws of England and Wales and will be subject to the exclusive jurisdiction of the English courts.

We cannot guarantee that your computer monitor’s display of any color will be accurate. Occasionally, we include product photography provided by end users or customers. Your submission of personal information through the store is governed by our Privacy Policy. Yoga My Life respects your privacy and will treat all information confidentially. This section informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site.

We require certain information in order to conduct our business together. Whilst using our Site, we may ask you to provide us with certain Personal Identity information which may include, but is not limited to your name and contact number (“Personal Information”). When placing an order through the site, we will collect (“Order Information”) such as name, billing, shipping address, email address, phone number and payment information (credit card numbers etc).
“Order Information” is used to fulfil orders, send them to you and to protect and screen our orders against fraudulent users. “Personal Information” may be used for marketing purposes sent with your permission. Personal Information provided by you will be used to help improve the Site and Services offered to you. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service, any related website or associated social media platform. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Log Data, Retention & Security
Like many site operators, we automatically collect information that your browser sends whenever you visit our Site (“Log Data”) e.g . your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. Upon placing an order our system will store your details for our records, unless you ask us to remove/delete them.
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

All rights, including copyright, in this website are owned by or licensed to Yoga My Life Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

ORDERING, BILLING & ACCOUNT INFORMATION

Orders & Payments
We thank you for purchasing products and services through Yoga My Life. By placing an order you agree to provide current, complete and accurate purchase and account information for all purchases made. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Payment of the price for the goods represents an offer on your part to purchase the goods, which will be accepted by us only when the goods are dispatched. Only at this point is a legally binding contract created between us.

You are able to correct errors on your order up to the point on which you click on “Place Order” during the ordering process.

Once you have placed an order online, you will be sent a confirmation email. If there are any problems with your order we will inform you as soon as possible. We reserve the right to refuse an order for any reason. In such circumstances we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Shipment & Delivery
We aim to process and dispatch all of our orders as quickly as possible subject to stock availability and volumes ordered (typically 1-3 working days for UK delivery). If we are experiencing a high volume of orders, shipments may be delayed so please allow up to 5 working days for UK delivery. In the event of any significant delay in shipment of your order, we will contact you via email or telephone. All delivery times quoted are subject to collection by our courier.

All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock, we will contact you by email or phone (if you have given us details). You will have the option either to wait until the item is available from stock or to cancel your order.
The specific timescales for any bespoke art orders/commissions undertaken by our Cherished Moments – Digital Design Art Service are outlined in the Design Brief on the Order Form.

Please note that we are able to deliver to addresses within the United Kingdom and Ireland but postage to the following areas may take longer than stated on the website – Isle of Wight, the Isle of Man, the Scottish Isles, parts of Scotland, Northern Ireland and the Channel Isles.

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed; If we have a problem or significant delay in delivery we will contact you and either agree a mutually acceptable alternative date, or offer you a full refund.

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. We will take payment upon receipt of your order from your credit or debit card. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights we may have.

Risk of damage to or loss of the goods passes to you at the time of delivery to you. If you choose to use your own courier then the risk passes to you as soon as the goods are handed to your courier. You will only own the goods once they have been successfully delivered.

We currently accept the following payment methods: Credit & Debit Cards. Payment will be taken at the time of checkout and all prices shown on the website are shown in Great British pounds (GBP).
Card payments shall be processed via Stripe.

Shipping Rates & Delivery Estimates for UK
Shipping charges for your order will be calculated and displayed at checkout. Items up to 2kg will be shipped via Royal Mail 1st Class.
Delivery delays can occasionally occur. All delivery estimates are based on orders being placed before 12pm on a given day.

Shipping Rates & Delivery Estimates for Europe
We currently only offer delivery for UK.

Please ensure your delivery address is correct as we cannot be responsible for parcels delivered to an incorrectly provided address. There will be an additional delivery charge for parcels redirected to any address other than the delivery address provided by the customer at checkout.

Secondary Carriers and Forwarding Agencies
If a customer chooses to use their own carrier or forwarding agency, Yoga My life is not liable or responsible for any loss or damage incurred once the order is in possession of said carrier or agency. Once the parcel has been signed for by the secondary carrier or forwarding agency, our liability ends. Yoga My Life is not liable for any products lost during shipping. Please contact the shipment carrier to file a complaint or claim.

Damaged Goods
Yoga My Life undergoes a product quality check before orders are dispatched. However, if you receive damaged goods, you must inform us immediately by email James insert correct email or call us on +44 (0)7988912925 within 2 days of delivery for us to arrange for an exchange or a refund. When contacting us, please include your order reference number, your full name, description and product code of the damaged items. We may ask for evidence, such as a photograph of the damaged products. If you wish for a refund for damaged goods, you will be refunded the full amount including the original delivery charges. It is your responsibility not to accept goods with any visible damage.

Returns, Cancellations & Refunds
Please contact us if you would like to discuss returning any products. Please note we are not able to accept returns for products that have been opened; used or made specifically for you. We are unable to accept returns on goods that have been designed and ordered through our Digital Design Artwork Service.

If you are not satisfied with the product that you have purchased from us, you can get your money back no questions asked if the product has not been opened and any security seals have not been broken. You are eligible for a full reimbursement within 14 calendar days from the day you receive your purchase. After the 14-day period, unfortunately we can no longer offer you a refund. To return a product, please contact us via email for instructions on how to handle the return. PLEASE DO NOT send any items back to us without prior arrangement. Your statutory rights are not affected. Please ensure to use tracking delivery, as a refund or return can only be processed when we have received the product.

We reserve the right to withhold a refund or return should the product be returned damaged due to inadequate packaging being used. We recommend using the original packaging for your return. If your product is processed for return or refund, we will reimburse you the price that you paid for the item, which is displayed on the original receipt. If a refund is granted then the monies shall be returned to the bill payer’s account via the original payment method used during checkout (Debit/Credit Card) within 5 Working Days.

Cancellation must be made within fourteen days of ordering in writing by any durable medium (for example letter sent by post or e-mail). Refunds for cancelled orders will be provided within 30 days of cancellation to your credit or debit card. Return postage for any cancelled order is the responsibility of the Customer. You cannot cancel your order if the goods or services you have ordered are bespoke i.e. made to order for you.

If you have received the goods before you cancel your order, you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

In the unlikely event you receive an incomplete, damaged or incorrect order, you must notify us within 24 hours of receipt. In the event of damage, you must retain all packaging. We will ask for photos in order to submit a claim to our carrier.

If you are returning an incorrect order or a product which was delivered to you in a damaged or faulty state, we would ask you to follow returns procedures set out above. We will refund you the purchase price, the delivery charge and any parcel carrier costs you incur.
When returning items you are recommended to keep a proof of posting. Proof of posting will not be accepted as proof of delivery. We will not accept responsibility for lost or damaged parcels.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY & INDEMNIFICATION

Liability
You agree that you are at your own risk when using the Yoga My Life website. You agree to have taken medical advice from your Doctor or Personal Physician before trying out any of the 5-Minute Yoga practices or if you have health concerns. We are not liable to any party in contract, tort or negligence for death, personal injury, damage, claim, loss, costs or expenses, specifically for:

• Any special loss
• Any loss of revenue, profits, business or contracts
• Any loss of data
• Any loss of reputation
• Any physical injury
• Reactions to our Skincare & Wellness Products

Our website may contain links to other sites – we are not responsible for the content on these sites.

We will endeavour to make our site available 24 hours a day. However, we reserve the right to occasionally restrict access or make our website unavailable without notice. We cannot guarantee that the website will be faultless at all times. In such circumstances we will do our very best to solve the problem as soon as possible. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

In no case shall Yoga My Life, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Yoga My Life and harmless from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

We make no warranty or guarantees regarding our products or information provided on our website. Instructions regarding burning candles; yoga and well- being practices and tips are provided for guidance only. It is your responsibility that our products and services are used safely. We will not accept responsibility for misuse.

Return Shipping Address
